This is second bail application under Section 438 of Cr.P.C. 2.

This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No. 255/2016 registered at Police Station City Kotwali, Raigarh for offence punishable under Section 420, 409/34 of IPC & Section 13(1)(d) of Prevention of Corruption Act.

The first bail application was dismissed as withdrawn on 25/01/2017. Perusal of the dismissal order dated 25/01/2017 would show that anticipatory bail application was dismissed as withdrawn with liberty to surrender and apply for regular bail before the concerned trial court. It was also observed that if such application is filed, the concerned trial court shall consider and decide the same as early as possible preferably on the same day, considering the nature of allegations. As appears, till date there is no compliance of the order dated 25/01/2017 and the applicant has not surrendered yet.

In view of this, I do no find any reason to reconsider this second anticipatory bail application. It is accordingly dismissed. It is further observed that in case the applicant resort to any other legal remedy he would be at liberty to do so as this court has not expressed any opinion on merit of the case.
