The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.103/2017 registered in Police Station Saja. District Bemetara (CG) for the offence punishable under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

By order dated 23-5-2017 passed in M.Cr.C.No.3160 of 2017, the first bail application was dismissed as withdrawn with liberty to move again after 2 months.

The applicant was allegedly found to be possessed of 4.900 kgs. of Ganja when he was intercepted while he was riding a motorcycle on Durg-Saja Road.

Having heard learned counsel for the parties; having regard to the facts and circumstances of the case; considering the fact that the applicant is in jail since 3-3-2017 i.e. for about six months; only 3 out of 19 witnesses have been examined so far; and the concerned Station House Officer has not reported any other crime of similar nature, this Court is inclined to release him on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one local surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
