Grievance of the petitioner is that the petitioner is working as Rural Health Organizer (Female) at Primary Health Center, Bhandaripara. She has been transferred by order dated 23/08/2019 to Primary Health Center Kivaibalenga. It is contended that transfer order itself contains a clause if on transfer seniority is affected then transferee may opt for not to accept the same and make representation. Since the petitioner's seniority would be affected on transfer to Kivaibalenga immediately representation was made by Annexure P-2 to cancel the transfer that transfer have not been accepted by the petitioner, same may be cancelled as per transfer order itself.

Considering the fact, it is directed that the petitioner shall make a fresh representation within a period of 15 days from today to the concerned respondent. If such representation is filed, same may be

decided within a further period of 45 days. Till then the transfer order dated 23/08/2019 in respect of the petitioner shall not be given effect to. 3.
