This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.84/2015 registered at Police Station- Rajput, District Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 302, 201, 34 of I.P.C. The first bail application was dismissed on merit on 04.01.2016 in MCRC No.7302/2015 and second bail application was dismissed on 29.02.2016 in MCRC No.1451/2016.

Case of the prosecution, in brief, is that the applicant along-with other co-accused Jaimuniya, Sumitra & Fulbai committed murder of Harilal. The deceased was husband of the applicant Jaimuniya and it is alleged that on 01.06.2015 at about 3.30 p.m., four accused persons had tied deceased with a rope and assaulted the deceased and thereafter he was set at large at 9 O'clock. Subsequently, on 09.06.2015, he was admitted to the Hospital and he died on 11.06.2015 during the course of treatment.

Learned counsel for the applicant would submit that the direction may be issued to the Court below to expedite the trial. 4.

Perusal of the record would show that the trial is being continued, however, the counsel prays for expedite trial. Considering the facts and circumstances of this case, I do not find any change of circumstances to reconsider the instant third bail application. Accordingly, the third bail application is dismissed.
