1. This is second bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicants in connection with Crime No. 122 of 2016 registered at P.S. Saragaon Distt. Janjgir Champa (C.G) for the offence punishable under Sections 294, 506, 323/34, 325, 307 of IPC.
2. The First bail application bearing M.Cr.C. No.1504/2017 was dismissed on 21.03.2017.
3. As per the prosecution case, a report was made by one Bhishma Suryawanshi that over a land dispute, the applicants attacked his family members and his father was assaulted by way of club whereby he sustained fracture of the right temporal bone and right ulna bone which were sufficient
to cause death and his father was admitted to hospital for 16 days.
4. On the last date of hearing learned State counsel was directed to ascertain the stage of trial, it is revealed that out of 14 witnesses, 6 witnesses have been examined.
5. Considering the fact that the trial is in progress and no enormous delay appears, I do not find any change of circumstances to reconsider this repeat bail application. It is accordingly, dismissed. However, learned trial Court is requested to expedite the trial, at the earliest. Sd/- Goutam Bhaduri Judge Ashu
