2. Learned counsel for the petitioner would submit that the petitioner is working as Lecturer in the Government Higher Secondary School, Madguri, Block Kushami, Distt. Balrampur- Ramanujganj (C.G.) and he has been transferred vide order dated 20.09.2019 (Annexure P-1) to High School Salwahi, Block - Ramchandrapur (C.G.) which is about 190 km away from the present place of

posting. He would further submit that the wife of the petitioner is also posted at Block Kushami as per Annexure P-3 and she is also suffering from various ailments. It is further contended that as per the policy of the State the Husband & Wife are normally kept/posted in the same place. Consequently, the transfer of the petitioner may be canceled.

3. Perused Annexure P-3 which prima facie shows that the wife of the petitioner is working at Block Kushami. Considering the same and also taking into the medical report as also the transfer policy, it is directed that the petitioner shall make afresh representation in this regard within a period of two weeks from today and the respondents in turn shall consider and decide the same in accordance with the transfer policy at the earliest preferably within a further period of 45 days. Till the representation of the petitioner is decided, if the transfer order is not carried out, the effect and operation of the order dated 20.09.2019 shall remain stayed so far as the petitioner is concerned.
