1. Heard.

2. Grievance of the petitioner is that initially the petitioner was transferred by order dated 14.08.2017 from Behara Bandh Beat, Khadgawan Range, Forest Division Baikunthpur to Kotya Beat, Khadgawan Range, Forest Division Baikunthpur, the said order could not be effected as the petitioner was not relieved.

3. Learned counsel for the petitioner would submit that the petitioner had made

representation thereafter recommendation was also made to relieve the petitioner. Eventually, the petitioner was not relieved and lastly on 23.08.2019, the petitioner has been transferred to Elephant Reserve, Sarguja. Therefore, it would amount to frequent transfer and the petitioner has not been allowed to join at the transferred place of posting i.e. Kotya Beat Khadgawan and was working at Behara Bandh Beat and in order to accommodate some other person, the petitioner has been again transferred, therefore, the transfer order may not be given effect to.

Considering the facts of this case, the petitioner was earlier transferred has not been given effect to again he has been transferred, it is directed that the petitioner shall make afresh representation in this regard before the concerned respondent within a period of two weeks from today and the respondents in turn shall consider and decide the same in accordance with the transfer policy at the earliest preferably within a further period of 45 days. Till the representation of the petitioner is decided, if the transfer order is not carried out, the effect and operation of the order dated 23.08.2019 shall remain stayed so far as the petitioner is concerned.
