Hon'ble Shri Justice P. Sam Koshy Order On Board 13/11/2018 The challenge in the present writ petition is to the order Annexure P2 dated 07.07.2018. 2.
On a query being put to the counsel for the petitioner as to whether the appointment has been made, he fairly admits that the appointment order has been issued to the selected candidate from the Department.
However, he submits that the person who was appointed has since resigned and the post is lying vacant.

Given the aforesaid factual matrix of the case, once when the advertisement Annexure P-2 has been acted upon and an order of appointment has been issued, the recruitment as such gets completed and nothing further remains to be done from the said advertisement. It is altogether different situation which the respondents would have to act upon while deciding how the vacant position has to be filled. The respondents would be free to engage the guest faculty who were engaged in the previous year if they ultimately feel so or can also go in for a fresh recruitment.
