Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 27/10/2017 Learned counsel for the applicant submits that the only ground on which the application for grant of bail is rejected, is delay in trial. It is further stated that the prosecutrix has died, therefore, there are bleak chances of conviction of the applicant.
Considering that only two witnesses have remained to be examined by the prosecution, I am not inclined to release the applicant on bail at this stage. Therefore, the application is rejected, however, with liberty to revive the application, in case, the trial is not concluded within a period of four months.
