1. Learned counsel for the petitioner would submit that the petitioner is a Senior Scientist working in Indra Gandhi Krishi Vishwavidyalaya and certain wheat variety were discovered by him which would be evident from Annexure P-3, which is popularly known as Chhatisgarh Genhu-3 and for other three products research is going on for which grant has also been given by the Central government. It is stated that the petitioner has been transfered from Bilaspur to Jashpur, in such case the research work will come to stand still which would eventually cause loss to the nation. Apart from it, it is also submitted that the daughter of the petitioner is studying in class 12th whereby this mid term transfer would cause huge loss.

2. Learned counsel for the respondents, on instructions, submits that the petitioner may file a representation before the Vive Chancellor (Respondent No.2) narrating all the grievances and the difficulties. It is further submitted that the research are not person specific, the grant is given to the institution. Further, if the representation if filed may be decided accordingly.

3. Considering the submission of the parties and further taking into documents filed along with the petition, the petitioner will be at liberty to file a representation before Vice Chancellor (Respondent No.2) within a period of two weeks from the date of receipt of copy of this order. Thereafter the Vice Chancellor may decide the same within a period of 45 days.

4. In the meanwhile, the transfer order of the petitioner shall not be given effect to.

5. Accordingly, the petition is disposed of.
