The present contempt petition has been filed alleging non compliance of the order dated 22.10.2018 passed by this Court in WPS No. 1303/2009. 2.

The Assistant Solicitor General has entered appearance for the respondents and submitted that as per the order passed by this Court dated 22.10.2018, the Petitioner's ACR was reconsidered and which was upgraded from 'Average' to "Very Good". Thereafter, the authorities concerned had convened the review DPC for considering promotion of the Petitioner from the post of Commandant to the post of Additional DIG and the review DPC was held on 11.10.2019. In the review DPC on perusal of the entire records, the authorities found the petitioner to be unfit for promotion and an order in this regard was passed on 20.11.2019 and the respondents have brought on record the order dated 20.11.2019.

Given the said fact that the respondents have now passed a final order in terms of the directions given by this Court on 20.10.2018, this Court is of the opinion that the order stands duly complied with. 4.

Accordingly, the contempt petition stands disposed of and the respondents stand discharged from the contempt proceedings. 5.

If at all, if the petitioner aggrieved of the subsequent order dated 20.11.2019, it is open for the petitioner to assail the same by way of a fresh proceedings.

Accordingly, the contempt petition stands disposed of. 7.
