1. The present is a repeat bail application filed under Section 438 of Cr.P.C. seeking for anticipatory bail to the applicant apprehending his arrest in connection with Crime No. 199/2016 registered at Police Station Jaijaipur, District Janjgir-Champa, Chhattisgarh for the offence punishable under Sections 420, 409, 467, 468, 471, 34 of I.P.C. The earlier bail application stood withdrawn by the applicant on 18.05.2017.

2. While withdrawing the earlier bail application, the applicant had taken the liberty of surrendering before the trial Court and to move an appropriate application under Section 439 of Cr.P.C. and it was also observed that if possible, the said application may be considered on the same day.

3. Barely a few months later except for the lapse of time no change in circumstances has been brought in by the applicant to reconsider the

case for grant of anticipatory bail. So far as granting of a bail to another co-accused person may not be relevant at this juncture when the applicant himself had been given a liberty of surrendering and moving for grant of regular bail before the appropriate trial Court

4. Maintaining the observations made by this Court while disposal of the earlier anticipatory bail application for consideration of the application under Section 439 of Cr.P.C. in the event of the applicant surrendering, if possible, on the same day, the present bail application stands disposed of.
