1. This is the Fourth Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested on 14.06.2015 in connection with Crime No.159/2015 registered at Police Station Bodhghat, District-Bastar at Jagdalpur (CG) for the offence punishable under Section 20 ([k) of the N.D.P.S. Act

2. As per the prosecution case, on 11.06.2015 the applicant who was having a car bearing Registration No. M.P. 17-TA/1807 and the car was loaded with the cannabis to the extent of 145.900 K.G. was recovered from the possession of the applicant. Thereby the offence has been committed.

3. Learned counsel for the applicant submits that there is no offence against the applicant and the car was in an open place and the applicant was not

found in the car, therefore, the applicant may be released on bail.

4. Per contra, learned State counsel opposes the prayer for grant of bail.

5. The First Bail application bearing M.Cr.C. No.7762/2015 was dismissed on 22.01.2016. The Second Bail application bearing M.Cr.C. No.1104/2016 was dismissed on 23.02.2016 and the Third Bail application bearing M.Cr.C. No.7871/2016 was dismissed on 13.12.2016. Considering the fact that the earlier bail application was dismissed as withdrawn with liberty to expedite the trial, I am not inclined to release the applicant on bail.
