It is contended that though the applicant was enlarged on bail by an order dated 09.08.2017 and his date of appearance before the Registry of this Court was given on 10.10.2017, however, till 10.10.2017 he could not furnish the bail and thereby he could not be released, therefore, he was not able to appear before the Registry of this Court on 10.10.2017. It is stated that because of the date, the bail bond though furnished is not accepted. 2.

Considering the fact that the applicant was released, the petition is allowed with an observation that the order dated 09.08.2017 shall be operative for suspension of sentence and grant of bail to the appellant. The appellant in compliance of the order dated 09.08.2017 shall appear before the Registry of this Court on 13th February, 2018. He shall thereafter appear before the trial Court on a date to be given by the Registry of this Court and shall continue to appear there on all such subsequent dates as are given to him by the said Court.
