Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 30/11/2017 None for the applicant even it was called on more than occasion.

1. The applicant has been arrested in connection with Crime No.218 of 2016 registered at Police Station- Pandri, District Raipur (C.G.) for the alleged commission of offence under Section 363, 376(2) of IPC & 3(a), 5(3)(6) of POCSO Act, 2012.

2. Case of the prosecution is that the applicant kidnapped and thereafter committed rape on the prosecutrix, who is stated to be minor.

3. Upon perusal of the case diary and the statement which have been placed on record, it cannot be said that the prosecutrix has turned hostile, at this stage. Therefore, without commenting upon the merits of the case, the application may be rejected.

4. Taking into consideration the nature and looking to the allegation, the application is rejected.
