Hon'ble Shri Justice P. Sam Koshy Order on Board 20.12.2021 .

1. The limited prayer of the petitioner in the present writ petition is for a direction to the respondent No.1 for taking a decision on the application that the petitioner has made for redressal of his dispute so far as the granting of extension of time with levy of liquidated damages.

2. The dispute has been raised before the respondent No.1 in terms of Clause-25 of the contract entered into between the parties which specifically provide for such an inherent.

3. The counsel for the respondents submits that subject to the petitioner having filed Annexure P/1 before the Chief Engineer, PWD, the respondent No.1, the same shall be considered and decided in accordance with law at the earliest.

4. Given the submission by the counsel for the parties, the writ petition stands disposed of subject to verification of facts that the petitioner has filed Annexure P/1, before the respondent No.1 in the capacity of a dispute reviewing expert in terms of the contract entered into between the

-2petitioner and the respondents and if the same is already filed and received in the office of the respondent No.1, the same be decided and adjudicated upon at the earliest preferably within a period of 28 days from the date of receipt of copy of this order.

5. The petitioner is directed to produce the copy of this order to the respondent No.1.

6. It is made clear that this court has not expressed any opinion so far as the merits of the case is concerned.
