This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.01/2015 registered at Police Station- Dongripali, District Raigarh (C.G.) for the offence punishable under Section 20(B) of Narcotic Drugs & Psychotropic Substances Act. The first bail application was dismissed on 31.08.2016 in MCRC No.5068 of 2016 and second bail application was dismissed on 02.05.2017 in MCRC No.3130 of 2017.

As per the prosecution case, on 10.01.2015 a Car bearing Regn. No. M.P.51CA/0120 which was transporting contraband cannabis was intercepted and at that time, the driver fled away from the vehicle. It is alleged that on a search being made, 60 Kgs of contraband was seized from the said vehicle.

Learned counsel for the applicant submits that the applicant has been falsely implicated and he is in jail since 26.06.2016, therefore, he may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and earlier bail rejection orders. After going through the earlier bail rejection orders, I do not find any change of circumstances to reconsider the instant third bail application.

Accordingly, the third bail application filed under Section 439 of Cr.P.C. is dismissed.
