This is the third bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.60 of 2015 registered at Police Station- Hasaud, Distt. JanjgirChampa (C.G.) for the offence punishable under Section 304-B, 498A & 109/34 of Indian Penal Code. The first bail application was dismissed as withdrawn on 16.12.2015 in MCRC No.7003/2015 and second bail application was dismissed as withdrawn with a request to expedite the trial on 27.02.2017 in MCRC No.1382/2017.

Learned counsel for the applicant submits that despite the fact there was a direction to expedite the trial, the trial has not been concluded within a short span of time, as such, the applicant is lodged in jail since 16.04.2015; therefore, he may be released on bail.

The order of the first bail application would show that the first bail application was dismissed as withdrawn and no liberty was reserved in such bail application. However, considering the fact that applicant is in jail since 16.04.2015 and as per the State counsel out of 33 witnesses 18 witnesses have been examined, it is directed that the trial Court shall conclude the trial within a further period of four months.
