This is the second application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.153/2017, registered at Police Station Koni, District Bilaspur (CG) for the offence punishable under Sections 363, 366, 376 (2) (N) of the IPC and Section 5 (N) of the Protection of Children from Sexual Offences Act, 2012.

Earlier bail application of the applicant has been rejected by this Court vide order dated 22.11.2017. Before passing order by this Court, the prosecutrix was examined before the trial Court.

Learned counsel for the applicant submits that this bail application may be disposed of as withdrawn with liberty to repeat the same after three months in case it is not decided on merits. 5.

Accordingly, the bail application is disposed of as withdrawn with liberty in favour of the applicant to repeat the same after three months if the case is not decided on its merits within a period of three months.

The bail application stands disposed of.
