1. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.32/2017, registered at Police Station Masturi District Bilaspur (CG) for the offence under Sections 394, 34 of IPC.
2. Considering the fact that only small items have been allegedly looted by the accused persons, including the present applicant, further considering the fact that the applicant is in jail since 26.1.2017 as also the fact that in a previously instituted case for offence under Section 457 & 380 of IPC, the applicant has already been acquitted vide judgment (Annexure A/5) and
particularly considering the fact that the offence is triable by the Judicial Magistrate First Class, this Court is inclined to release the applicant on regular bail.
3. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
