Versus

State of Chhattisgarh through Station House Officer, Police Station Kondagaon, District Kondagaon Chhattisgarh --- Respondent 10.01.2018 Shri Uttam Pandey, Counsel for the Applicant. Shri Ashish Shukla, Dy. G.A. for the State.

This is third bail application. The first one was dismissed on 25.10.2016. the second one was dismissed on 24.08.2017.

As per the prosecution case, the applicant pretended himself to be the officer in the PHE Department and he along with one co-accused collected Rs.73 lakhs from as many as 43 persons on the allurement of providing jobs, thereby the offence is committed.

Learned counsel for the applicant submits that out of 72 witnesses, only 20 have been examined and some of them have not supported the case of prosecution and the trial will likely to take time, therefore, the applicant may be enlarged on bail.

Per contra, learned State Counsel opposes the prayer for grant of bail. Considering the fact that the earlier bail application was dismissed on 24.8.2017, I do not find any change of circumstances to reconsider the bail within a short span of time.
