The present is a repeat bail application filed under Section 439 of CrPC seeking for grant of bail to the Applicant who is in jail since 17.1.2017 in connection with Crime No.25/2017 registered at Police Station- Pulgaon, District- Durg, for the offence punishable under Sections 302, 307, 323, 212, 147, 148, 149, 34 of IPC. 2.

The earlier bail application of the Applicant stood rejected by this Court on 1.9.2017 in M.Cr.C. No. 2319/2017.

Learned Counsel for the Applicant submits that the co-accused persons, particularly the main-accused Rounak Dubey, on whose memorandum statement the present Applicant was implicated in the case, has already been released on bail and the other co-accused persons, namely, Saurabh Pandiya and Ravi Sonkar, have also been granted bail by this Court. He thus submits that the allegations against the present Applicant being similar in nature, the present Applicant also deserves to be released on bail on the ground of parity.

Learned Counsel for the State on verifying the facts does not dispute the fact that the allegations are similar.

Given the facts and circumstances, particularly the fact that the coaccused persons, particularly Rounak Dubey, Saurabh Pandiya and Ravi Sonkar, have already been released on bail by this Court and the allegations against the present Applicant being similar, this Court is of the opinion that prima facie a strong case is made out for grant of bail to the present Applicant also.

Accordingly, the application for grant of bail is allowed. It is ordered that the Applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with one surety of the like sum to the satisfaction of the concerned Trial Court for his appearance as and when directed.
