For Respondent/State Mr. S.K. Mishra, PL Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 2-111. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.

2. The applicant has been arrested in connection with Crime No. 101/2018 registered in police station Ranitarai, Distt. Durg (CG) for offence punishable under Section 379, 411, 34, 420, 467, 468, 471 of IPC.

3. Prosecution story in brief is that on 11-9-2018 at village Belhari, 25 H. Beam Electric Poles were stolen by some unknown person. Complicity of the applicant is mentioned in his memorandum which is not admissible in evidence.

4. Counsel for applicant submits that co-accused Nagesh Kumar Koushik and Jitendra Kumar Yadav have been enlarged on bail on 30-12-2018 by coordinate bench of this Court in MCRC No. 8059/2018 and MCRC No. 8122/2018. Hence the applicant may also be granted bail on ground of parity.

5. Govt. Advocate submits that no criminal antecedent of the applicant is reported in the police case diary.

6. Looking to the above facts and circumstances of the case,

application is allowed. It is ordered that if the applicant furnishes one solvent surety for a sum of Rs. 25,000/- along with one personal bond of the like sum to the satisfaction of the trial Court concerned, he be released on bail.
