1. Mr.Ashish Shrivastava, learned counsel for the petitioner would submit that cement plant of petitioner-Bhilai Jaypee Cement Limited is situated under Industrial Zone-4 and accordingly, property tax is paid. However, the respondent-Municipal Corporation, Bhilai is insisting that the petitioner's property is situated under Zone-1, which is commercial zone. He would further submit that objection with regard to payment of property tax has been raised by the petitioner Company to the respondent-Corporation on 22.6.2011, yet decision has not been taken by the respondent-Corporation on said objection.
2. Mr.H.B.Agrawal, learned Senior Counsel along with Mr.Pankaj Agrawal, learned counsel for the respondents would submit that decision will be taken by the respondent-Corporation on the petitioner's objection within a period of six weeks.
3. Be that as it may, respondent No.1-Municipal Corporation, Bhilai is directed to consider and dispose of the petitioner's objection within a period of six weeks from the date of receipt/production of certified copy of this order after hearing the petitioner. It is made clear that this Court has not expressed any opinion on merits of the case.
4. With the aforesaid observation, the writ petition finally stands disposed off. No cost(s).
