Hon'ble Shri Justice P. Sam Koshy Order On Board 22.10.2019
1. The relief sought for by the petitioners in the present writ petition is for an appropriate direction to the respondents for restoration/reinstallation
of electricity connection in the premises where the petitioners are residing.
2. Shri Varun Sharma, Panel Lawyer of respondents 2 to 4 was directed on the previous date to seek instruction.
3. Shri Sharma, counsel for respondents 2 to 4, on instruction, makes a submission that the electricity connection has been disconnected at the request of the consumer in whose name electricity connection in the said premises exists and they are bound to do that otherwise they would find difficulty to collect electricity charges. He submits that there appears some family dispute between the petitioners and their father in whose name the electricity connection is and therefore such a situation has arisen. He further submits that in the event the petitioners apply for a fresh connection, a fresh connection can be provided subject to the NOC providing by the owner of the house.
4. Given the aforesaid facts and circumstances of the case, this Court is of the opinion that at this juncture it would be difficult to issue any direction to the respondents so far as the restoration/reinstallation of electricity connection is concerned. Reserving the right of the petitioners to avail other remedies open to them and also for approaching the appropriate authority in an appropriate forum for redressal of their grievance, the present writ petition in its present form stands dismissed.
