Hon'ble Shri Justice Goutam Bhaduri Order On Board 21/10/2019

1. The grievance of the petitioner is that the petitioner has been transferred from Government Higher Secondary School, Ragja, Block Sakti, District Sakti to Government Higher Secondary School, Belmundi, Block Takhatpur, District Bilaspur vide order dated 21.08.2019, the petitioner has been relieved on 26/08/2019 from the earlier place of posting but he is not

allowed to join at the transferred place i.e. at Belmundi, Block Takhatpur, District Bilaspur.

2. The issue regarding implementation of transfer order has been considered by this Court in the case of Ms. Manisha Agrawal v. State of Chhattisgarh and others, 2015(4) C.G.L.J.182, wherein relying upon several judgments of the Supreme Court, it has been held by this Court that once the employee has been transferred, it is required to be complied with unless it is modified, varied or cancelled.

3. Accordingly, the writ petition is disposed of with a direction that the petitioner shall be allowed to join the transferred place of posting within a further period of three weeks from the date of receipt of copy of the order. Sd/- Goutam Bhaduri Judge gouri
