Taking into consideration the cause shown, we are satisfied that the reason for non appearance was bonafide and not deliberate. Therefore, the order of dismissal for want of prosecution is hereby recalled and review petition No. 95/2010 its restored to its original number subject to cost of Rs. 1,000/- to be paid to the High Court Legal Aid.
