This is the Second Bail application under Section 439 of the CrPC. First bail application was dismissed on merits on 25/09/2018. 2.

The applicant has been arrested in connection with Crime No.491/2018 registered in Police Station Outpost Karhi Bazar, Police Station Balodabazar, District Balodabazar-Bhatapara (C.G.) for the offence punishable under Section 34(2) of CG Excise Act and Section 83(2) of Juvenile Justice (Care and Protection of Children) Act, 2015.

Case of the prosecution, in brief is that on 17/08/2018, 9.00 bulk liters of country made liquor has been seized from the possession of the applicant. 5.

Counsel for the State submits that four criminal cases has been registered against the present applicant.

There is no change of circumstance which may entitle applicant to get benefit of Section 439 of CrPC in this second bail application. Accordingly, his bail application is rejected.
