Mr. Shakti Raj Sinha, Advocate For Respondent No. 1 :
Mr. K.R. Nair, Panel Lawyer Hon'ble Shri Justice P. Sam Koshy Order on Board 17.10.2019
1. The challenge in the present Writ Petition is to the Electricity Bill dated 14.09.2019 Annexure P-1 issued from the office of the Respondent No. 01.
2. Shri K.R. Nair, Panel Lawyer for the respondent company present in the Court is directed to appear on behalf of the company.
3. The contention of the petitioner is that, the respondents have abruptly issued Annexure P-1, the electricity bill for an amount of Rs. 2.69 lacs, without there being any sort of assessment made. That the petitioner has been regularly paying all the bills and dues that were payable as per the bills that were being raised periodically. However, abruptly now Annexure P-1 has been issued, without giving details of the same and the
respondents have also cut the electricity supply of the petitioner's residential house.
4. From the pleadings available with the petition and also from the submissions made by the counsel for the petitioner, it appears that he has never been given an opportunity of hearing nor has he been given with any details, in-respect of the bill raised for an amount of more than Rs. 2.69 lacs.
5. Given the facts and circumstances of the case, this Court is of the opinion that ends of justice would meet, if the writ petition is disposed-off with a direction to the petitioner to approach the Respondent No. 1 within a period of 7 days from the date of receipt of copy of this Order and the Respondent No. 1 in turn shall provide all necessary details showing as to how the bill has come to an amount of rupees more than 2.69 lacs.
6. After giving the details to the satisfaction of the petitioner, the petitioner undertakes to deposit whatever admissible dues with the Respondent No. 1.
7. Given the said facts, the Writ Petition stands disposed-off. Meanwhile, it is also directed that the Respondent No. 1 shall ensure that till the proceedings are pending before the Respondent No. 1, electricity supply of the petitioner shall stand restored forth-with.
8. Shri K.R. Nair, Panel Lawyer appearing for the Respondent No. 1 is directed to apprise the other respondent, so far as the order passed by this Court is concerned.
