1. These are the First Bail Applications under Section 439 of Cr.P.C. The applicants have preferred these applications for grant of bail as they are
arrested in connection with Crime No.01/2017, registered in Police Station Simga, District Baloda Bazar Bhatapara for offence under Section 20 (B) Narcotic Drugs and Psychotropic Substances Act.
2. Having considered the nature of allegations wherein the applicant Bhagwani Prasad Yadu was found to be in possession of 2KG Ganja and applicant Yogeshwar Das was found in possession of 2.5KG of Ganja in a common raid and for the fact that the applicants are in jail since 02.01.2017 and the concerned police has not reported any previous antecedent of commission of similar nature of crime, the prayer for grant of bail is allowed.
3. Accordingly, the application is allowed and the applicants are directed to be released on bail on their executing a personal bond in sum of Rs.25,000/- each with one surety in the like sum to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
