Sam Koshy Order On Board 17/05/2017 The present application under Section 438 of Cr.P.C. has been filed seeking for grant of anticipatory bail to the applicant apprehending his arrest in connection with Crime No. 19/2016 registered at P.S. BaghNadi, Rajnandgaon (CG) for the offence punishable under Sections 420, 120-B, 467, 468, 471 of IPC.
The case as per the prosecution is that the present applicant, being the Patwari at the relevant point of time, in connivance with other accused persons, is said to have prepared revenue records, Rinpustika and Kisan Book, proclamation made by the Tahsildar and also using a fake power of attorney has got the sale deed executed of the property which otherwise stood in the name of Uday Ram.
Considering the nature of allegation levelled against the present applicant and the role played by him, this Court is of the opinion that it is not a fit case where the present applicant can be granted the advantage of anticipatory bail.
Accordingly, the instant application filed under Section 438 CrPC stands rejected.
