This is the First Bail Application under Section 439 of Cr.P.C. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 46 of 2017, registered at Police Station Simga, District Balodabazar-Bhatapara (C.G.), for the offence punishable under Sections 354 and 354-A of I.P.C.

Considering the fact that the prosecutrix is aged about 20 years; the offence is triable by Magistrate First Class carrying the maximum punishment of R.I. for three years under Section 354-A of I.P.C., as also for the fact that the applicant is in jail since 9.2.2017, he is entitled to be released on bail.

Accordingly, the bail application is allowed. It is directed that the applicant shall be released on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court.
