----Respondents For petitioner - Shri Manoj Kumar Jaiswal, Advocate. For State-Shri Soumya Rai, PL.
Hon'ble Shri Justice Goutam Bhaduri Order 24/10/2019 1.
Grievance of the petitioner is that the petitioner who was working as Ayurved Medical Officer at Govt. Ayurved Medical College, Bilaspur has been transferred to Primary Health Center, Korba-12, District Korba. It is stated that the petitioner has already joined the place of posting, however despite the fact policy of the State that husband and wife in the government service are normally should be kept at the same place, at the same time wife of the petitioner has transferred from Mungeli to Bilaspur. It is further contended that the petitioner therefore had made a representation by Annexure P-3 to the State which may be directed to be decided according to the policy of the State. 2.
This is not disputed by the State that wife of the petitioner has been transferred on the same date from Mungeli to Bilaspur and the petitioner has been transferred from Bilaspur to Korba on the same date.
3.
Considering the fact that the petitioner had already joined the transferred place of posting and representation has already been made which is pending with the respondent, the petitioner is given liberty to make fresh representation to the respondents No.1 and 2 within a period of three weeks from today and same may be decided within a further period of 90 days.
4.
With such observation, the petition stands disposed of. Sd/- (Goutam Bhaduri) JUDGE gouri
