Mr. Suryakant Mishra, Panel Lawyer for the State. Heard Learned counsel for the applicant submits that vide order dated 25.02.2012 regular MJC for confiscation of the vehicle was registered and since the main order was passed on 25.02.2012, therefore, virtually it would be extension of the earlier order as MJC is continued in pursuant to the main order.

Perused the order sheet of the MJC. The MJC was registered on 25.02.2012 and notices were issued. Consequently, the applicant submits that he wants to withdraw the petition to avail the appropriate remedy available to him under appeal.

Considering the facts of this case, as the MJC arises out of the main order and is in continuation of the main order dated 25.02.2012 passed in Special Trial No.2/2011 by the Special Judge (NDPS Act) Mahasamund, the applicant is allowed to take back this revision petition to avail the appropriate remedy of appeal, if so advised. Accordingly, the revision is dismissed as withdrawn with the aforesaid liberty.

Registry is directed to return the certified copy of the order after retaining the photocopy of the same.
