1. The grievance of the petitioner is that the petitioner is aged more than 55 years and have been working as SDO PWD Sub Division Ambikapur and has been transferred to SDO Sub Division Kanker.

2. It is contended that as per the transfer policy of the government normally people above 55 years are not transferred to scheduled area and it is stated that transfer of petitioner is done to accommodate Respondent No. 3. It is further contended that petitioner has a son totally handicapped and is being looked after by the petitioner which is evident from the disability certificate

Annexure P-4. Therefore, the transfer of the petitioner shall be cancelled.

3. Considering the fact, the disability certificate of the son of the petitioner and the fact that petitioner is aged more than 55 years the petitioner is given liberty to file a representation to concerned respondent within 15 days from the date of receipt of copy of this order. Thereafter, the respondent shall decide the same within a further period of 45 days, till then the transfer order of petitioner shall not be given effect to.
