1. This is the third bail application filed by the applicant under Section 439 of the CrPC for releasing him on regular bail during trial in connection with Crime No. 02/2017 registered at Police Station Kondagaon for the offence punishable under 20-B of the NDPS Act.

2. First bail application moved by the applicant was dismissed as withdrawn by order dated 02/07/2018 and his second bail application was dismissed on merits vide order dated 02/08/2019 holding that he was found in unauthorized possession of 36.880 kgs of Ganja.

3. Mr. Rajesh Jain, learned counsel for the applicant after arguing for a fairly long time would submit that learned trial Court be directed to expedite the trial and he also submits that the Investigating Officer is not attending the trial.

4. Be that as it may, Superintendent of Police, Kondagaon is directed to keep the Investigating Officer present in the trial Court in the next date of hearing/or any other date with the leave of that Court.

5. With the aforesaid direction, this MCRC stands disposed of. No cost(s).

6. A copy of this order be sent to the Superintendent of Police, Kondagaon for compliance and needful.
