Learned counsel for the petitioner would submit that the petitioner has not been given increment in the salary having not passed the B.Ed/D.Ed examination. He further submits that the issue with regard to withdrawal/ non grant of increment on the ground of having not passed B.Ed/ D.Ed examination was examined by the Court in the case of Jayant Kumar Patle v. State of Chhattisgarh (W.P.S. No.4271 of 2017 and batch of petitions, vide order dated 03.11.2017) and various directions have been issued for affording proper opportunity of hearing and then decide the matter. 2.
Learned State counsel would submit that the petitioner's claim would be examined if the petitioner makes a representation in this regard and the case would be considered in terms of the order dated 03.11.2017 passed in case of Jayant Kumar Patle (supra). 3.
Considering the aforesaid submission, this petition is finally disposed off with a direction that the petitioner if make a
representation to the respondent No.2, C.E.O. Zila Panchayat Korba, the same would be decided keeping in view the various orders passed in other cases including the principles, which is decided in case of Jayant Kumar Patle (supra) and pass the suitable orders. It is observed that the representation may be made within a period of 30 days and the authorities concerned shall be obliged to decide the same within a further period of 90 days.
