At the outset, learned counsel for the petitioners submits that he do not want to press this petition on behalf of petitioner No.2, Duple Sahu. Accordingly, the petition is dismissed as not pressed on behalf of petitioner No.2.

In respect of petitioner No.1, it is contended that the petitioner No.1 was earlier working in the Panchayat Department and subsequently he was appointed in Municipal Corporation, therefore, as per the order passed in case of Mukesh Kumar Patel & Another v. State of Chhattisgarh & Another in W.P.S. No.2530 of 2017 wherein the circular dated 23.04.2016 has been quashed, the petitioner would be entitled to obtain the benefit of revised pay-

scale on completion of eight years of service by including the services rendered by him on the lower post or on the same post. 3.

In view of the aforesaid submission, the case of the petitioner may be considered and if he is entitled to get the revised pay-scale on completion of eight years of service by including the period of earlier post, the lis may be considered and decided in view of the principles laid down in case of Mukesh Kumar Patel & Another (supra).
