1. Heard.

2. The grievance of the petitioner is that by order dated 03.10.2019 he has been transferred from Public Works Department (Bridge), Sub-Division Narharpur to Incharge Executive Engineer, Public Works Department (B/R) which is 400 kms away from the present place of posting.

3. The contention of the petitioner is that the petitioner is more than 55 years he has been transferred from Kanker, which is a scheduled area to core scheduled area Sukma and as per the policy of the State the persons who are more than 55 years are normally not sent to scheduled area.

4. Considering the facts of the case, it is directed that the petitioner shall make afresh representation in this regard within a period of two weeks from today before the concerned respondent and the said respondent in turn shall consider and decide the same in accordance with the transfer policy at the earliest preferably within a further period of 45 days. Till the representation of the petitioner is decided, the transfer of the petitioner shall not be given effect to.
