Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 14/07/2017 Heard.

1. This is the second application for grant of bail to the applicant. The first bail application was rejected by this Court on 19.12.2016 after perusal of the diary.

2. Learned counsel for the applicant submits that this application has been moved mainly on the ground of delay in trial. The applicant is stated to be in jail from 13.3.2016 but till now, the trial is not concluded. On this ground, learned counsel for the applicant prays that the applicant may be released.

3. On the other hand, learned counsel for the State opposed the bail application on the submission that the applicant is being tried for commission of offence under Section 376 IPC read with Section 4 of the POCSO Act against a minor, therefore, the applicant is not entitled to grant of bail only on the ground of delay.

4. Having considered the submissions made by learned counsel for the parties, I

-2am not inclined to grant bail to the applicant at this stage only on the ground of delay.
