Challenge in the present Writ Petition is to the order Annexure P/1 dated 30.09.2019 passed by the Respondent No.2-Collector, Bemetara. 2.

The matter relates to removal of the petitioner from the post of Sarpanch. The petitioner immediately preferred an appeal before the Collector, District Bemetara, where the appeal has been admitted, however, the application for interim relief has been rejected by the Collector. The Collector has called for the entire records for passing a final order on the appeal. The next date of hearing is also fixed on 17.10.2019. Meanwhile, the petitioner has rushed to this court by filing present writ petition challenging the order dated 30.09.2019 passed by the Collector.

Since the matter has already been seized by the Collector and the matter is also listed for final disposal before the Collector, this court is of the opinion that no strong case is made out by the petitioner calling for an interference with the impugned order dated 30.09.2019, rather ends of justice would meet if this petition itself is disposed of with a direction to the respondent No.2-Collector, Bemetara, to decide the case of the petitioner at the earliest.

It is ordered accordingly.
