This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.149/2018 registered at Police Station Charama, District Kanker for the offence punishable under Section 34(2) of Chhattisgarh Excise Act.

The first bail application of the applicant was rejected on merits by the order of this Court dated 03.10.2018 passed in M.Cr.C. No.6776 of 2018.

Counsel for the applicant submitted that charge-sheet has been filed hence the applicant may be released on bail. 4.

Looking to the above mentioned facts and circumstances of the case and after filing of charge-sheet there is no such change in the circumstances of the case by which the applicant is entitled to get the benefits of Section 439 of CrPC. Consequently, the second bail application of the applicant is rejected.
