Admittedly the appeal preferred by the petitioner before the concerned Collector challenging the order under Section 40 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 is pending consideration, therefore, ends of justice would be served if the writ petition is disposed of with a direction to the concerned Collector to hear and decide the petitioner's appeal on merits within a reasonable time preferably within a period of 3 (three) months from today.

Accordingly, the writ petition is disposed of. 3.
It is made clear that the interim order passed in favour of the petitioner shall continue during pendency of the appeal before the Collector.
