1. On due consideration delay of 173 days in filing of the Cr.M.P. is condoned. Accordingly, I.A. No. 01/2019, application for condonation of delay in filing of the Cr.M.P. is allowed.

2. The trial Court has acquitted the accused of the charges under Section 376(ख)(ञ) and Section 506 Part-II of the

CRMP No. 2455 of 2019 I.P.C.

3. Prosecutrix aged about 35 years has not supported the prosecution and has been declared hostile. She has denied that the accused has ever committed forcible sexual intercourse with her.

4. In view of the statement of prosecutrix, no case for grant of leave to appeal is made out.

5. Accordingly, the Cr.M.P. deserves to be and is hereby dismissed.
