Agrawal Order On Board 02/11/2018 (1) The applicant's first bail application was dismissed as withdrawn with liberty to repeat the same after examination of material prosecution witnesses by order dated 25.06.2018 passed in M.Cr.C. No. 3280 of 2018.

(2) The accused/applicant has moved this second bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 9/2018 registered at Police Station Bamhanidih, District Janjgir Champa (C.G.) for the offence punishable under Section 304(B) of the Indian Penal Code. (3) Having heard learned counsel for the parties, having regard to the facts and circumstances of the case, I do not find any change in circumstances to entertain this second bail application, therefore, this second bail application is rejected.
