The present contempt petition has been filed by the petitioner alleging noncompliance of the order dated 2.9.2019 passed by this Court in WPS No. 6743/2019.

The contention of the petitioner, who was not a party to the said writ petition, is that the said order dated 2.9.2019 has been obtained by suppression of facts and by misleading the Court.

While disposing of the said writ petition, this Court had not made any observation on the merits of the case. This Court had only directed the State authorities to consider the representation of the petitioner therein and take a decision within a period of 45 days. It is expected that while taking a decision on the said representation, the State authorities would be verifying the contents of the representation while deciding the same including the contention of the petitioner therein that he has already worked in a scheduled area between 2012 to 2018.

This Court, prima facie, is of the opinion that the said submission of the petitioner which is still to be verified by the State authorities would not bring the case within the ambit of the contempt jurisdiction. 5.
