The order under challenge in the present writ petition is Annexure P1 dated 12.03.2018 whereby the petitioner has been transferred from Gram Panchayat, Amtahi to Gram Panchayat, Sabag within the same Janpad Panchayat.

Perusal of the record would show that the impugned order was passed on 12.03.2018 and the present writ petition has been filed after about 8 months on 30.10.2018. In a case where the challenge is to an order of transfer, this Court finds it difficult to entertain the writ petition in exercise of its power under Article 226 of the Constitution of India where the transfer order itself has been challenged after about 8 months. Counsel for the petitioner has not been able to show any justified reason for not challenging the impugned order promptly as also not in a position to disclose as to whether the order under challenge in between has been complied with or not.

Given the said facts, this Court does not find any merit in the present writ petition and the same fails and is accordingly dismissed. Sd/- (P. Sam Koshy) JUDGE Bhola
