Versus
Jai Prakash Mourya, Collector, Rajnandgaon, Collectorate Building Rajnandgaon (C.G.) ---- Respondents/contemnors.
For Petitioner : Shri H.B. Agrawal, Senior Advocate with Smt. Preeti Yadav, Advocate.
For Respondent : Shri Ravi Bhagat, Advocate. Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 29/11/2019 1.
This contempt petition has been preferred for non compliance of the order dated 19.04.2017 passed in W. P.
(227) No. 1061 of 2015, whereby this Court has directed the Collector, Rajnandgaon to decide the application for permission to sell the lease land in light of provisions contained in Section 158 (3) of the M.P./C.G. Land Revenue Code, 1959.
2.
It is stated at the bar now the Collector, Rajnandgaon has decided the petitioner's application for permission to sell the lease land afresh by order 8.1.2018 and rejected the same. As such, the order complained of dated 19.04.2017 has already been complied with substantially.
3. In view of the fact that respondent has substantially complied with the order of this court, I do not find any reason to proceed further in the matter initiating contempt
proceeding against the respondent.
4. Accordingly, contempt petition is closed. However, the petitioner is at liberty to challenge the order dated 8.1.2018 in accordance with law, if aggrieved by that order. Sd/- (Sanjay K. Agrawal) Judge D/-
