This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this court and his no bail application is pending before any other court. 2.

The applicant has been arrested in connection with Crime No.66 of 2018 registered at Police Station, District Excise Circle, Dhamtari, District Dhamtari for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act.

The prosecution story in brief is that 19.800 bulk liters of hand made country liquor was seized from the possession of the applicant. 4.

Counsel for the applicant argued that the applicant is innocent and falsely implicated hence he be released on bail. 5.

On the other hand, the Panel Lawyer appearing for the State opposed the bail application and submits that there is two other criminal cases registered against the applicant.

Looking to the above facts and circumstances of the case, it is ordered that the applicant shall be released on bail on his furnishing a personal bond for a sum of Rs.25,000/- with two sureties of the like sum to the satisfaction of the concerned Trial Court for his appearance at 11 AM as and when directed.
