There is no merit in this application to warrant interference against judgment of acquittal because the prosecutrix (PW4), in the opening of her evidence, has stated that the accused is her husband and she has denied commission of offence of rape but has stated that there was some dispute between them. On the face of such evidence, learned Trial Court was left with no option but to acquit the respondent. Therefore, no case for grant of leave to appeal is made out.
